1. Acceptance of These Terms
These Terms of Service (“Terms”) govern your access to and use of WatermarkGoGo (the “Service”), operated by the solo founder of WatermarkGoGo (“we,” “us,” or “our”). By accessing or using the Service (including as a guest), you agree to be bound by these Terms, our Privacy Policy, and our Acceptable Use Policy (“AUP”).
If you do not agree, do not use the Service.
2. The Service
WatermarkGoGo is a browser-based AI video cleaning tool that lets users upload a video, select an area to be cleaned (e.g., unwanted overlays), submit a processing job, and download the processed result.
Important: The Service is provided as an automated software tool. Output quality varies depending on the input video and selected area.
3. Eligibility
You must be legally able to enter into a binding contract in your jurisdiction to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
4. Accounts, Guest Mode, and Sign-In
Guest Mode. You may be able to experience parts of the workflow (e.g., upload/preview/selection) without an account, but we may require sign-in before you can submit a processing job.
Third-Party Sign-In. We may support sign-in via third-party authentication (e.g., Google).
Account Security. You are responsible for all activity under your account and for maintaining the confidentiality of your credentials and device access.
5. Credits, Pricing, and Payments
Pay-as-you-go. The Service uses a prepaid credit model (no mandatory subscription).
Credit Consumption. Processing a video typically costs a fixed number of credits (e.g., “1 video = 10 credits”).
Credit Packs. We may offer one-time credit packs (including “base” and “bonus” credits). The credits included and price are shown at checkout and may change over time.
Payment Processor. Payments may be processed through a third-party payment provider (e.g., Stripe Checkout). We do not store full payment card details.
No Guarantee of Availability. Credit packs, pricing, and availability may vary by region and may be modified or discontinued.
6. Usage Limits and Technical Constraints
To ensure reliability, fairness, and cost control, we may enforce limits such as:
- Supported file types (e.g., MP4/MOV) and size limits (e.g., up to 200MB)
- Duration limits (e.g., short-form videos; a hard cap may apply such as 20 seconds)
- Resolution limits (e.g., longest side up to 1920px)
- Concurrency limits (e.g., one active processing job per user at a time)
- Rate limits and anti-abuse controls
We may change these limits at any time. If you exceed or attempt to bypass limits, we may reject requests or restrict access.
7. Your Content and Permissions
You retain ownership of your uploaded videos (“User Content”).
License to operate the Service. You grant us a limited, non-exclusive, worldwide license to host, store, process, transform, transmit, and display your User Content solely to provide and improve the Service, and to comply with law and enforce our policies.
You are responsible for rights. You represent and warrant that you own or have all necessary rights, permissions, and consents to upload and process User Content, and to receive and use the output.
8. Trust & Safety, Verification, and Content Moderation
To prevent abuse and unlawful use, we may:
- Require anti-bot verification (e.g., Cloudflare Turnstile) before allowing processing
- Run automated content moderation checks (e.g., sampling frames from a video) to detect prohibited or high-risk content and reject processing
- Apply rate limiting and other safeguards
If we reject a job due to policy or safety reasons, we may decline to process it and may not send it to compute infrastructure; credits may be refunded where appropriate under our internal rules.
9. File Retention and Deletion
We are designed to minimize storage of your videos:
- Uploaded videos and processed outputs are generally deleted automatically within about 1 hour after upload/processing (a “burn-after-reading” approach)
- We may retain limited non-content records (e.g., transaction logs, system logs) longer for security, billing, fraud prevention, and legal compliance purposes
10. Third-Party Services and Links
The Service may rely on third-party infrastructure and vendors (e.g., hosting, storage, payments, analytics, error tracking).
We may also display third-party links (including affiliate links). We are not responsible for third-party websites or services.
11. Intellectual Property
The Service (including its software, UI, branding, and documentation), excluding User Content, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, reverse engineer, or exploit the Service except as permitted by law.
Copyright complaints. If you believe content processed through the Service infringes your copyright, please submit a report via our Help & Feedback page with sufficient details to investigate (e.g., the work claimed to be infringed and the relevant link or other identifying information).
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that:
- the Service will be uninterrupted, secure, or error-free
- output will be accurate, complete, or meet your expectations
- the Service will remove any specific overlay or achieve any particular result
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR USD $100, WHICHEVER IS LOWER), UNLESS APPLICABLE LAW REQUIRES OTHERWISE.
14. Indemnification
You agree to defend, indemnify, and hold harmless WatermarkGoGo and its operator, contractors, service providers, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content or your violation of these Terms or the AUP.
15. Suspension and Termination
We may suspend or terminate your access to the Service at any time if we reasonably believe you violated these Terms or the AUP, attempted to bypass safeguards, or created security or legal risk.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms on our website and update the “Last Updated” date. Continued use after changes means you accept the updated Terms.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict of law principles. The courts of Hong Kong will have non-exclusive jurisdiction over any disputes, unless applicable law provides otherwise.
Nothing in these Terms affects any rights you may have under applicable consumer protection laws, including any right to bring claims in your local courts where such rights cannot be excluded.
